Brookmont Property Development Pty Ltd (ABN 28 169 280 193) trading as Brookmont (“Brookmont”, “we”, “us” or “our”) is committed to protecting your privacy. This Policy explains how we collect, hold, use and disclose personal information, and how you can access or correct your information or make a complaint. It is written to comply with the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (“APPs”).

By using this website or otherwise providing us with your personal information, you agree to this Policy.

We may update this Policy from time to time by posting an updated version on our website.

What personal information we collect

We collect personal information that is reasonably necessary for our functions and activities, including:

  • your name, email address, telephone number and any other information you give us when you submit an enquiry, register your interest or correspond with us;
  • if you take steps towards a purchase, identity verification information such as your proof of identity, details of any company or trust involved in the purchase (including who ultimately controls it) and, in some cases, information about the source of your funds;
  • if you are an employee or prospective employee, information necessary for recruitment and employment;
  • if you are a supplier or other business contact, your name, contact details and information relevant to our business relationship; and
  • if you interact with us through our website or social media channels, online data collected using cookies or similar technology as described below.

 

How we collect your personal information

We usually collect personal information directly from you, including when you complete an enquiry form on this website, register your interest in a lot or house and land package, correspond with our sales team or upload identity documents through our verification platform.
In some circumstances, where it is unreasonable or impracticable to collect information from you directly, we may collect information about you from a third party or publicly available source.

If you do not provide the personal information we request, we may not be able to respond to your enquiry, provide our services to you or proceed with a sale.

Why we collect, use and hold your personal information

We collect, hold and use your personal information for the following purposes:

  • to respond to your enquiry and provide information about available lots and house and land packages;
  • to facilitate the sale of land or house and land packages;
  • to comply with our legal obligations, including identity verification obligations under anti-money laundering laws (see below);
  • to send you marketing information and updates about the development, where you have consented or would reasonably expect to receive them.

We will only use or disclose your personal information for these purposes, a related purpose you would reasonably expect or otherwise with your consent or as required or authorised by law.

Who we may disclose your personal information to

We may disclose your personal information to:

  • our sales agent;
  • our builder partners in connection with house and land packages;
  • marketing service providers who assist us to communicate with you;
  • identity verification providers;
  • technology and system service providers who support our website and business operations;
  • other third party agents or contractors who assist us to carry out our functions and activities; and
  • our professional advisers, such as lawyers and conveyancers.

We require our service providers to handle your personal information consistently with the APPs and in accordance with applicable law.
We do not ordinarily disclose your personal information to overseas recipients unless we tell you at the time we collect it. If we do disclose your personal information to an overseas recipient in the future, we will take reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to that information, or we will obtain your consent prior to making such a disclosure.

Identity verification under anti-money laundering laws

If you proceed with, or take steps towards, a purchase, we may ask you to provide:

  • proof of identity (for example, a copy of your passport and driver’s licence);
  • details of any company, trust or other entity involved in the purchase, including information about who ultimately controls it; and
  • in some cases, information about the source of your funds.

We will send you a secure link by SMS or email to upload your documents through a secure verification platform. When you provide personal information through our platform provider, it is stored in the platform provider’s systems, which are hosted in Australia. We require our verification provider to handle personal information safely and securely, in accordance with the APPs and appropriate contractual safeguards.
These requirements are imposed by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). We will only collect the personal information that is reasonably necessary to meet these obligations. Other parties involved in your transaction, such as your conveyancer, may make similar requests separately.

Cookies and website usage data

Our website may use cookies or similar technology to collect information such as your server address, top level domain, the date and time of your visit, the pages you access, the previous site you visited and your browser type. We use this information to understand how our website is used and to improve it.

Third party websites and social media

Our website contains links to third party websites, including our Facebook and Instagram pages. Those sites are not operated or controlled by us, and this Policy does not apply to them. Once you leave our website, you are subject to that third party’s own privacy practices.

Direct marketing

We may use your personal information to send you marketing communications and updates about the Brookmont development, including new land releases, house and land packages, events and construction progress. We will only do so where you have consented or where you would reasonably expect to receive such communications from us.
You can opt out of receiving direct marketing from us at any time by contacting our Privacy Officer using the details below or by using any unsubscribe facility in our communications. We will action your request as soon as possible.

Storage and security

We take reasonable steps to protect your personal information from misuse, loss, interference and unauthorised access, using physical, technical and procedural safeguards, whether your information is held electronically or in physical form. These safeguards include:

  • imposing confidentiality requirements on our employees;
  • implementing policies in relation to document storage security;
  • implementing security measures to govern access to our systems;
  • only providing access to personal information once proper identification has been given;
  • controlling access to our premises; and
  • implementing website protection measures.

We will take reasonable steps to destroy or de-identify personal information once it is no longer needed for any purpose for which it may be used or disclosed under the APPs, unless we are required by law to retain the information.

Data breach notification

If we become aware of a data breach involving your personal information that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Privacy Act. We will take prompt steps to contain the breach, assess the risk of harm and take appropriate remedial action.

Anonymity and pseudonyms

Where it is lawful and practicable, you may deal with us anonymously or using a pseudonym, for example when making a general enquiry about our lots or packages. Once you take steps towards a purchase, it will no longer be practicable for us to deal with you anonymously, including because of our identity verification obligations described above.

Access to and correction of your personal information

You can ask us to access, update or correct the personal information we hold about you at any time by contacting our Privacy Officer using the details below. We will take reasonable steps to verify your identity before responding to your request, and will aim to respond within 30 days. If we refuse your request, we will explain why and how you can complain about that decision.

How to make a complaint

If you believe we have breached this Policy or the Privacy Act, you can make a written complaint to our Privacy Officer using the contact details below. Please include your contact details so we can respond to you. We will aim to respond within 30 days. If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner at www.oaic.gov.au or by calling 1300 363 992.

Changes to this Policy

We may update this Policy from time to time. The “last updated” date at the top of this Policy shows when it was last changed.
